NspirePro Subscription Agreement & Terms of Use

This Agreement is a contract between you ("Subscriber") and Kendra REAC Consultant, Inc. ("Provider," "we," "us"). By requesting access, paying a subscription fee, or using NspirePro (the "App"), you agree to these terms. If you do not agree, do not use the App.

2. Cancellation and refunds

You may cancel at any time by contacting administration@reacnspire.com. Cancellation stops future renewals; it does not retroactively refund a period already paid. Fees are non-refundable except where required by law. Cancelling during the free trial avoids any charge.

3. One account, one device

Each subscription is a single-user, single-device license. Signing in on a new device signs the account out on the previous device. Sharing your user ID and password with others is prohibited and is grounds for suspension without refund.

5. Not affiliated with HUD; estimates only

NspirePro is an independent tool and is not affiliated with, endorsed by, or acting on behalf of the U.S. Department of Housing and Urban Development (HUD) or REAC. Scores the App produces are estimates for field use only. Scoring is computed by NSPIRE Standard calculations. You are responsible for verifying all findings and must not represent the App's output as an official HUD result.

6. Optional AI feature

The App includes an optional feature that, if you supply your own third-party AI provider API key, can analyze a photo and suggest a possible deficiency. Any such suggestion is a non-authoritative aid, not a determination. When you use this feature, the photo and your prompt are sent to the AI provider you configured, under that provider's terms and privacy policy. You are responsible for your API key, any usage charges from that provider, and for independently confirming every finding.

7. Data

Inspection data is stored on your device. We do not host or collect your inspection content on our servers. Account information you provide (name, email, phone, user ID, plan) is stored to operate your subscription. See the Privacy Policy.

8. Availability and changes

We aim for continuous availability but do not guarantee uninterrupted service. We may update, improve, or discontinue features, and may revise these terms; material changes will be posted here with a new date. Continued use after a change constitutes acceptance.

9. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or that its estimates will match official results.

10. Limitation of liability

To the maximum extent permitted by law, Provider's total liability arising out of or related to the App or this Agreement will not exceed the amount you paid in the twelve (12) months preceding the claim. Provider is not liable for indirect, incidental, consequential, or punitive damages, or for any inspection outcome, failed inspection, penalty, or loss resulting from reliance on the App's estimates.

11. Suspension and termination

We may suspend or terminate access for non-payment, credential sharing, or breach of these terms. On termination, your right to use the App ends; your on-device data remains yours.

12. Governing law

This Agreement is governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Florida.
